1. Who we are
This online store (store.roseoptom.co.nz, the "Store") and the website roseoptom.co.nz are owned and operated by:

Rose Optometry is an independent, locally owned optometry practice that has served the Waikato for over 50 years, and is affiliated with the New Zealand Eye Research Centre (NZERC). By using the Store you agree to this Legal Notice, our Terms of Service, and our Privacy Policy. If you do not agree, please do not use the Store.
2. Professional regulation and clinical standards
Our optometrists and dispensing opticians are registered with the Optometrists and Dispensing Opticians Board of New Zealand (ODOB) and hold current Annual Practising Certificates. We practise under the Health Practitioners Competence Assurance Act 2003, the ODOB Standards of Clinical Competence and Ethical Conduct, and the Code of Health and Disability Services Consumers' Rights.
Prescription products — including spectacle lenses, prescription sunglasses and contact lenses — are supplied only against a valid prescription from a registered practitioner. We may verify your prescription with you or your prescriber before dispatch and may decline to supply a product that is expired, incomplete or clinically unsuitable. Contact lenses are medical devices; please follow the wear schedule and care instructions supplied, and attend your recommended aftercare appointments.
3. Health New Zealand and health-sector compliance
As a health provider we handle your information under the Privacy Act 2020, the Health Information Privacy Code 2020, the Health Act 1956, the Health (Retention of Health Information) Regulations 1996 and the Health Information Security Framework (HISO 10029) issued by Health New Zealand | Te Whatu Ora. Where we provide publicly funded or ACC-funded services, or refer you to hospital eye services, we share the information Health New Zealand or ACC require for that purpose. Health information is stored and secured to HISO 10029 standards, and clinical records are retained for at least 10 years from your last care. Full details are in our Privacy Policy.
4. How we use data, AI and marketing — and your right to opt out
Rose Optometry uses data responsibly to grow a practice that can keep investing in better care and technology. In summary:
- Marketing. With your consent (or, for existing customers, unless you opt out) we may send you email, SMS and in-app communications about eye health, products, offers and events, and may use your hashed email or phone to show you relevant advertising on platforms such as Meta, Google and TikTok. We never use your clinical diagnosis for advertising and never sell your personal information.
- Personalisation. We may tailor the Store, recommendations and reminders to your prescription, purchases and preferences.
- AI tools. We use AI to assist our clinicians (imaging analysis, documentation), to serve you faster (chat, reminders, recommendations, virtual try-on) and to run our business (forecasting, fraud prevention, analytics). A registered clinician always makes clinical decisions; AI assists, it does not decide. We do not allow third-party AI providers to train on your identifiable health information, and we will not train our own models on it without your explicit opt-in consent.
- Research. De-identified data may support eye-health research, including with NZERC. Identifiable data is used in research only with your explicit consent and ethics approval.
Your right to opt out. You can opt out of marketing, personalisation, ad audiences, AI-assisted personalisation and communications, use of your data to improve our AI tools, and research use — individually or all at once — by emailing ops@roseoptom.co.nz (for example "Opt out of all optional uses"), by clicking unsubscribe in any email, by replying STOP to any SMS, or by managing cookies through the banner on our sites. Opting out never affects your clinical care or essential order and appointment communications. The full list of choices and timeframes is in section 10 of our Privacy Policy.
5. Consumer law and governing law
The Store is operated from New Zealand and governed by New Zealand law. Our dealings with consumers are subject to the Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Contract and Commercial Law Act 2017, the Privacy Act 2020 and the Unsolicited Electronic Messages Act 2007. Nothing in this notice or our Terms of Service excludes or limits any right you have under New Zealand consumer law that cannot lawfully be excluded. If you purchase goods for business purposes, the Consumer Guarantees Act does not apply to the extent permitted by law.
6. Prices, product information and availability
All prices are in New Zealand dollars (NZD) and include GST unless otherwise stated. We take care to keep product descriptions, images, stock levels and prices accurate, but errors can occur. We may correct errors, change or withdraw products and prices, and cancel orders placed on the basis of a genuine error, at any time without prior notice; if we cancel an order you have paid for, we will refund you in full. Colours, finishes and fit may vary slightly from what is shown on screen. Subscription products (such as contact lens auto-replenishment) renew on the stated cycle until you cancel through your account or by contacting us.
7. Health information disclaimer
Content on the Store and our website — including articles, product descriptions, AI-generated recommendations and virtual try-on tools — is provided for general information only. It does not constitute clinical advice, diagnosis or treatment and does not replace a comprehensive eye examination by a registered optometrist. If you have concerns about your eyes or vision, book an appointment; if you experience sudden vision loss, eye pain, flashes or a curtain across your vision, seek urgent medical care.
8. Intellectual property and user content
All content on the Store — the Rose Optometry and NZERC names and logos, text, images, video, product descriptions, graphics, software, design and layout — is owned by or licensed to Visique Rose Optometrists Limited and protected by New Zealand and international copyright and trade mark law. You may view and print pages for personal, non-commercial use only. Third-party brand names, logos and product images belong to their owners and are used only to identify genuine products.
If you submit a review, photo, testimonial or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, display and adapt it in connection with our business and marketing, and you confirm you have the right to grant that licence. You can ask us to remove your content at any time by emailing ops@roseoptom.co.nz. We may moderate or remove content that is unlawful, misleading, offensive or infringes others' rights.
9. Acceptable use and security
You agree not to misuse the Store, including by attempting to gain unauthorised access, scraping or harvesting data, introducing malicious code, impersonating others, placing fraudulent orders, or using another person's prescription or account without authority. We may suspend or cancel accounts or orders where we reasonably suspect misuse or fraud.
10. External links and third-party services
The Store may link to, or integrate with, third-party websites and services (including payment providers, courier tracking, booking tools and social platforms). These are provided for convenience only. We do not control and are not responsible for their content, availability or privacy practices; their own terms and policies apply.
11. Limitation of liability
To the fullest extent permitted by law, Visique Rose Optometrists Limited, its directors, employees and agents are not liable for any indirect, incidental, special or consequential loss, or loss of profit, data or goodwill, arising from your use of or inability to use the Store or reliance on its content. Where liability cannot be excluded, it is limited, at our option, to resupplying the goods or services or refunding the price paid. Nothing in this section limits liability that cannot be excluded under the Consumer Guarantees Act 1993 or other New Zealand law.

If you have a concern about any product, service or how we have handled your information, please contact us first at ops@roseoptom.co.nz or 07 847 3195 so we can put it right.
Any dispute that cannot be resolved is subject to the non-exclusive jurisdiction of the courts of New Zealand.
13. Changes to this notice
We may update this Legal Notice from time to time. Material changes — including any change to how we use data, AI or marketing — will be notified on the Store or by email before they take effect. The "Last updated" date shows the current version.
